I was hurt at work and my employer does not have workers comp. Can I sue him? Is there a fund to pay me benefits?
Employees of uninsured employers who are injured on or after December 12, 1985 can both sue their employer in a civil action and file a claim against the Worker's Compensation Trust Fund at the DIA. If you were injured before that date, you cannot file against the trust fund. You have the right to sue your employer.
